Jul 18, 2010 | 17 civil society actors, representing more than 200 civil society organisations, and several media organisations, unite before the approaching Kabul Conference to ask the Afghan Government to pass the draft Act of Access to Information prepared by Civil Society and Human Rights Network to grant Afghan citizens their constitutional right following Art 50 to access information. According to a recent survey in 2010, bribery has doubled in the last three years and amounts close to one billion dollars. The lack of information provides a prosperous environment for corruption, bribery and deprives citizens from accessing public services provided by the Afghan government and foreign assistance. قربانيان را قرباني نكنيد:
تأمین عدالت، پیش شرط مهم برای صلح دوام دار
مطالبات گروه هماهنگي عدالت انتقالي افغانستان از شركت كنندگان كنفرانس لندن
گروه همآهنگی عدالت انتقالی که متشکل از نمایندگان 24 نهاد ملی و بین المللی جامعه مدنی فعال در زمینهء حقوق بشر و دفاع از حقوق قربانیان جنگ است، به این باور است که صلح پایدار در افغانستان زمانی تأمین خواهد شد که فرهنگ متداول معافیت از مجازات خاتمه یابد و حاکمیت قانون مورد احترام قرار گیرد.
گروه عدالت انتفالی از دولت افغانستان و جامعه بین المللی می خواهد تا در باره موارد زیر اقدام کنند:
قابل توجه دولت افغانستان
1. دولت افغانستان باید اطمینان دهد گفتگو ها و مذاکره با گروه های مخالف، از جمله مخالفین مسلح، به صورت شفاف و واضح صورت می گیرد و و از هرگونه معامله سیاسی که ناقض حقوق بشر باشد، خود داری شود.
2. دولت افغانستان باید دوباره به اجرای برنامهء عمل صلح، عدالت و.مصالحه متعهد شود و با همکاری نزدیک جامعه مدنی بخش ویژه ای را برای اجرای آن تشکیل دهد.
3. دولت افغانستان باید دستگاه قضایی کشور را تقویت کند و به فرهنگ معافیت از مجازات خاتمه دهد.
4. دولت افغانستان باید ازایجاد مکانیزم های حقیقت یابی و دادخواهی حمایت کند.
5. دولت افغانستان باید فرایند بررسی و تحقیق را تقویت کند تا متهمین به جنایت های جنگی و دیگر جنایت ها از دست یابی به مقام های دولتی باز مانند.
6. دولت افغانستان باید به نیازهای قربانیان و درخواست های جبران و خسارت توجه ویژه نشان دهد.
7. دولت افغانستان باید قانون عفو را مطابق با استاندارد های بین المللی حقوق بشر اصلاح و تعدیل نماید.
8. دولت افغانستان باید حقوق بشر را ترغیب، تشویق و حمایت کند و تمام اقدامات ضروری را برای رسیدگی و تعقیب قانونی تهدیدها و حملات علیه مدافعان حقوق بشر را انجام دهد.
قابل توجه جامعهء جهانی
1. جامعه بین المللی باید از حمایت از مذاکرات غیر شفاف با گروههای شورشی خودداری ورزد. بعلاوه، جامعه بین المللی باید در تمام مذاکرات، احترام به استانداردهای حقوق بشر و کنوانسیون هایی که دولت افغانستان آنها را تصویب کرده است رارعایت کند.
2. جامعهء بین المللی باید بر اجرای کامل برنامهء عمل صلح، عدالت و مصالحه توسط دولت افغانستان تاکید ورزد.
3. سازمان ملل باید یک گزارشگرویژهء حقوق بشر برای افغانستان تعیین نماید.
4. جامعه بین المللی باید ارتباط بین فرهنگ معافیت و نقض دائم حقوق بشر را بپذیرد و به این مسئله توجه جدی نماید.
5. مکانیزم های موجود تحویل کمک های بشردوستانه را، به خصوص به آن دسته از شهروندان افغانستان که در اثر جنگ متقبل تلفات شده اند، تقویت و حمایت نموده و راه های دستیابی قربانیان به حقوق خود را تقویت نماید.
6. تمام نیروهای نظامی بین المللی در افغانستان مکلف اند قوانین بین المللی بشردوستانه را مراعات نموده وپاسخگوی هرگونه نقض آن باشند.. در طی عملیات نظامی باید اقدامات احتیاطی اضافی برای پرهیز از تلفات غیرنظامی انجام شود.

The relevance of the ICC has been keenly felt in Afghanistan since 2001. During this period, human rights violations have continued unabated, a culture of impunity and lack of accountability has been further entrenched, and the Afghan state has displayed a chronic lack of commitment to hold accountable those responsible for heinous crimes and massive human rights abuses.
